In the Antietam Campaign:
LCol Fowler reported that "after the first advance [17 Sept] from the meadow upon the plowed field, the colonel not being present, as a necessity I, without orders, assumed command." He was wounded in the combat at the Sunken Road on 17 September. As Major Richard C. Bentley, and all but one of the other officers of the Regiment were either killed or wounded, Joseph O'Neill, Company A, the only unwounded officer present at that time, assumed command when Fowler was carried off.
