Before the Antietam Campaign:
He was from Madison, Alabama, and was Captain of Company I, 4th Alabama Infantry. He was wounded at Malvern Hill on 1 July 1862.

In the Antietam Campaign:
He assumed command as Senior Captain when Colonel McLemore was wounded at South Mountain on September 14. Colonel Law's Report states "[at Sharpsburg] the Fourth Alabama pushed into the wood in which the skirmish had taken place the evening previous and drove the enemy through and beyond it .... Captain Scruggs commanding the Fourth Alabama received wounds while discharging his duty."

The remainder of the War:
He was Lieutenant Colonel and commanded the Regiment by Gettysburg in July 1863 and served in that position through to the Appomattox Campaign. He was wounded for the third time in action at Chickamauga in September 1863.
