He was captured in action on 14 September 1862 at Fox's Gap.

The rest of the War

Held at Fort Delaware, he was sent to Aikens Landing, VA and exchanged on 10 November 1862. He returned to his Company on 15 December 1862, but was discharged 4 February 1863 for being overage.
