Before Sharpsburg

He was commissioned Lieutenant, Company H, 5th Alabama Infantry, date not given. He was appointed Assistant Adjutant General on General Rodes' staff on 16 November 1861. He resigned 14 December 1861, but was reappointed 28 January 1862, to rank from 28 November 1861. He was offered the commission as Lieutenant Colonel, 41st Alabama Infantry on 5 August 1862, but declined.

On the Campaign

From General Rodes' Report:

I was most ably and bravely served during the whole day [14 September on South Mountain] by Captains [H. A.] Whiting and [G.] Peyton and Lieut. John Birney, who composed my staff ... [on 17 September at Sharpsburg] Captain Whiting and Lieut. John Birney, C. S. Army, of my staff, were both wounded. They, with Capt. Greene Peyton, assistant adjutant-general, discharged their respective duties with ability and gallantry.

The rest of the War

He was promoted to Major and Assistant Adjutant General (AAG) on 12 May 1863. He was probably AAG to General Ramseur in September and October 1864, and with General Grimes AS Assistant Adjutant and Inspector General afterward. He was surrendered at Appomattox Court House, VA on 9 April 1865.

After the War

He was a civil engineer.
