He was killed in action at Turner's Gap on South Mountain, MD on 14 September 1862, the day before his 23rd birthday.

He married Adalissa Jane "Lillie" Camp (1834-1905) in 1860. His only child, son John Drayton Hill Mintz (1862-1935) was born the day after he was killed; father and son had the same birth date.
His brother John S. Mintz (b. 1841), also a Private in Company C, survived the Maryland Campaign and the war.
