Before Sharpsburg

In 1860 he was an 18 year old farm worker on his parent's place near Pruntytown, Taylor County, VA; his father John Rutherford was a miller there. He enlisted there as a Private in Company A, 31st Virginia Infantry on 15 May 1861.

On the Campaign

He was captured in action at Sharpsburg on 17 September 1862.

The rest of the War

He was paroled on 21 September 1862 and returned to duty. He was wounded at Fredericksburg, VA on 13 December 1862. His last military record was for a clothing issue in November 1864.

After the War

In 1880 he was a farmer in Marion County, WV. In 1900 he was a fire clay miner in the Union District of Marion County, but had retired there by 1910.
