He was killed in action on 17 September 1862 at Antietam.

In 1988 relic hunters found human remains on the battlefield. They were later identified through the research of a group of Park Service anthropologists and archaeologists as being those of 4 soldiers of the 63rd New York Infantry. They were buried with honors in Antietam National Cemetery. One of them may have been James McGarigan. See more in a 1994 article in the Los Angeles Times.
