Age 43, he enlisted in New York to serve three years and mustered as Private, Company A, 63rd New York Infantry on 7 August 1861.
On the Campaign
He was killed in action on 17 September 1862 at Antietam.

In 1988 relic hunters found human remains on the battlefield. They were later identified through the research of a group of Park Service anthropologists and archaeologists as being those of 4 soldiers of the 63rd New York Infantry. They were buried with honors in Antietam National Cemetery. One of them may have been James McGarigan. See more in a 1994 article in the Los Angeles Times.
