Before Sharpsburg
Son of a wealthy lawyer (d. 1856), he was an attorney in Decatur and Dekalb, GA before the war. He enrolled at age 23 at Covington in Newton County, GA and was elected 2nd Lieutenant of Company A, Cobb's Legion Infantry on 1 August 1861. He was promoted to First Lieutenant on 14 December.
On the Campaign
He was killed "instantly" in action at Crampton's Gap on South Mountain on 14 September 1862.
The rest of the War
His widow filed for his final pay of $222 in March 1863.

He married Lucy Hyde Branch (later Pharr, 1843-1922) in June 1861 in Hillsborough County, FL and they had a son Richard Lee, III (1862-1922).
Younger brother Arthur was also in Company A. Older brother James Phillip Simms (1837-1887) served in the 53rd Georgia Infantry and was Brigadier General by the end of the war.
