Unit history
Designated the "8th Infantry Battalion" at least through January 1862, they joined Archer's Brigade as the 5th in June of 1862. They were at Mechanicsville and Gaines' Mill, where the 5th lost their colors to the 2nd Maine. At 2nd Manassas the battalion was again engaged, and their commander, Captain Thomas Bush was killed (29 Aug 1862). He was relieved in command by (then) Lieutenant Charles M. Hooper.
On the Sharpsburg Campaign
After the capture of Harpers Ferry the 5th remained on guard duty, as the rest of Archer's Brigade (A. P. Hill's Light Division) marched to Sharpsburg on 17 September. No losses are reported for the 5th Battalion during the Harper's Ferry and Antietam Campaigns.

The battalion surrendered 125 officers and men at Appomattox Courthouse 9 April 1865.
