On the Antietam Campaign

Lieutenant Colonel Pinto of the 32nd New York Infantry was assigned temporary command of the regiment on 13 September 1862, in relief of Colonel Calvin E. Pratt, who had been discharged on 10 September to accept the commission of Brigadier General of Volunteers. Pinto led the 31st New York in action at Crampton's Gap on South Mountain on 14 September but was ordered back to command the 32nd NY on the 17th, leaving the Major of the 31st, Alexander Raszewski, in command.1

Scott Hartwig2 notes a newspaper clipping - from Washington, May 21 - puts Pratt in command of the 31st at Antietam; this seems unlikely, and I don't believe that's what the clipping said.

After the Antietam Campaign

Pinto was offered the commission of Colonel of the 31st Infantry on 1 October (to date from 13 September) 1862, but declined in favor of the Colonelcy of the 32nd New York, same date. The Adjutant, Frank Jones was commissioned Colonel, 31st New York Infantry on 25 November 1862 (to date from 13 September).
